Incest is a sexual relationship between two family members who are biologically or legally related. As we mentioned earlier, incest can certainly be illegal in Ohio. As an example, it is against the law for a parent or parental figure to have sex with their child.

When a parental figure has intercourse with their child, it is considered sexual battery, which is a third-degree felony that carries a maximum prison sentence of five years, fines of up to $10,000, and registration as a sex offender. If the child is under 13 years of age, then sexual battery is a second-degree felony, punishable by imprisonment for up to eight years, fines of up to $15,000, and sex offender registration.

When age of consent is at issue, problems still arise if the older person is an authority figure, such as a parent, teacher, coach, or church group leader. Additionally, child pornography laws still apply if a person photographs or films a minor in the nude or while committing a sexual act.
