Ohio Revised Code 2903.12(A) defines aggravated assault through the accused person’s conduct and the circumstances surrounding it. Aggravated assault is an offense of lesser degree than felonious assault, but it isn’t a lesser-included offense. Aggravated assault is generally classified as a fourth-degree felony in Ohio. It becomes a third-degree felony when the alleged victim is a peace officer or an investigator with the Ohio Bureau of Criminal Investigation.

A mandatory prison term applies when a peace officer or Ohio Bureau of Criminal Investigation investigator suffers serious physical harm in an aggravated assault case. This enhancement makes the alleged victim’s status and the evidence of that harm especially important to the charge.
