Ohio’s Public Indecency Law: What Prosecutors Must Prove

Ohio Revised Code section 2907.09 is the statute behind every indecent exposure charge in Cincinnati. The terms “indecent exposure” and “public indecency” refer to the same offense and are used interchangeably throughout Ohio courts.

The statute covers conduct across two subsections. The reckless-conduct subsection prohibits exposing private parts, engaging in sexual conduct or masturbation, and engaging in conduct that, to an ordinary observer, would appear to be sexual conduct or masturbation. A separate knowing-conduct subsection addresses those same acts when directed toward a minor and also covers exposing private parts with the purpose of personal sexual arousal or gratification or to lure a minor into sexual activity. A public location isn’t required. Sexual conduct in a private setting can still support a charge if someone in physical proximity is affronted.

Prosecutors must also prove the mental state behind the act. The statute requires either reckless conduct, meaning a careless disregard of whether others would be offended, or knowing conduct, meaning awareness that others were likely present. Purely accidental or negligent exposure doesn’t satisfy this threshold. The conduct must have occurred under circumstances where it was likely to be viewed by and affront someone in the accused’s physical proximity, and that person can’t be an adult household member or spouse of the accused.

Penalty Ranges Under ORC 2907.09

Ohio’s penalty structure escalates based on prior record, the nature of the conduct, and whether a minor was involved.

• Fourth-degree misdemeanor: First offense for recklessly exposing private parts. Up to 30 days in jail and a fine up to $250.
• Third-degree misdemeanor: Second adult-victim offense (one prior conviction, no minor present), or a first offense involving masturbation or sexual conduct. Up to 60 days and a $500 fine.
• Second-degree misdemeanor: Second offense involving a minor witness, third adult-victim offense (two prior convictions, no minor present), or second masturbation/sexual conduct offense. Up to 90 days and a $750 fine.
• First-degree misdemeanor: Third offense involving a minor witness, or masturbation/sexual conduct involving a minor witness on a second offense, among other escalating combinations. Up to 180 days and a $1,000 fine.
• Fifth-degree felony: Repeat offenses involving minors or conduct involving exposure for sexual gratification toward a minor. Six to 12 months in prison and a fine up to $2,500.

Under ORC 2907.09, Tier I sex offender classification can result from a conviction for knowingly exposing genitals to a minor for personal arousal or to lure the minor into sexual activity. Classification is mandatory when the offender is 10 or more years older than the minor and has a prior conviction under this section. When the offender is less than 10 years older than the minor, or has no prior conviction, the court has discretion on whether to impose classification. Tier I registration requires annual registration for 15 years.

Collateral consequences can outlast any jail sentence: difficulty finding employment or housing, immigration consequences, professional licensing restrictions, and, for felony convictions, loss of firearm rights.

Common Defense Strategies in Indecent Exposure Cases

A public indecency charge has specific elements, and the prosecution must prove each one beyond a reasonable doubt. Defenses target those elements directly.

Substantive Defenses

• Lack of required mental state: Accidental or negligent exposure doesn’t satisfy the reckless or knowing standard the statute requires.
• Excluded victim category: Adult household members and spouses fall outside the statute’s protection, providing a complete defense in those situations.
• Lack of physical proximity: If the alleged victim wasn’t close enough that a reasonable person would feel the need to move away, the proximity element fails.
• Lack of affront: A witness who consented to or wasn’t offended by the conduct doesn’t satisfy the statute’s affront requirement.
• Mistaken identity: Eyewitness misidentification, particularly in low-light or crowded settings, can lead to wrongful charges. Alibi evidence and witness credibility challenges are both available tools.
• Insufficient evidence: Gaps in physical or testimonial evidence may prevent the prosecution from meeting its burden.

Procedural Defenses

• Unlawful search and seizure: Evidence gathered in violation of the Fourth Amendment may be suppressed.
• Miranda violations: Statements taken without proper warnings can be excluded from trial.
• Fifth Amendment protection: Investigators often seek statements from the accused to secure the evidence needed to file charges. Exercising the right to silence early can limit the prosecution’s ability to build its case.

How a Public Indecency Case Moves Through Hamilton County Courts

The Hamilton County Prosecuting Attorney’s Office, through its Sexual Offender Unit, handles public indecency prosecutions in Cincinnati. The path a case takes depends on how it’s charged.

Misdemeanor charges don’t require a grand jury and may be initiated by summons. Felony-level charges must go through grand jury indictment before the case proceeds. Once charges are filed, the defense receives discovery materials, including witness names and the evidence the prosecution intends to use. That information shapes both plea negotiations and trial strategy.

First-offense misdemeanor cases may be eligible for plea negotiations that can result in reduced charges or fines without going to trial. Felony charges and cases involving minor victims are harder to resolve through negotiation alone. Misdemeanor cases are heard in Hamilton County Municipal Court. Felony cases move to Hamilton County Common Pleas Court. Cases with minor victims may involve added procedural steps such as in camera hearings or closed-circuit testimony.
