How Ohio Law Treats Prescription Fraud

Ohio law uses separate statutes to address false prescription records and deception used to obtain medication. The distinction matters because the state must connect its evidence to the conduct prohibited by the charged statute.

Illegal Processing of Drug Documents

Ohio Revised Code 2925.23 prohibits knowingly making a false statement in a prescription, order, report, or record. It also covers making, uttering, selling, or knowingly possessing a false or forged prescription, an uncompleted prescription blank, or an official written order. In this context, uttering means presenting or using a false document as genuine.

The statute contains exceptions for licensed health professionals, pharmacists, pharmacy owners, and certain other people whose conduct complies with applicable licensing requirements. Whether an exception applies depends on the person’s role, authorization, and conduct surrounding the document.

Deception Used to Obtain a Dangerous Drug

Ohio Revised Code 2925.22 separately prohibits obtaining a prescription or dangerous drug by deception. This provision focuses on the means used to obtain the drug rather than solely on whether a prescription or related record was forged.

Allegations may arise from false information, altered records, forged prescriptions, or doctor shopping. Doctor shopping generally refers to seeking controlled-substance prescriptions from multiple prescribers without disclosing relevant prescriptions or treatment.

Felony Levels Under Section 2925.23

The drug schedule and alleged conduct affect the offense level under Section 2925.23 of the Ohio Revised Code. A drug schedule is the legal classification assigned to a controlled substance based on factors established by law.

Ohio law classifies these alleged violations as follows:

A violation involving a schedule I or II substance, excluding marijuana, is a fourth-degree felony.
A violation involving a dangerous drug, schedule III, IV, or V substance, or marijuana is a fifth-degree felony.
Certain violations identified in Section 2925.23(B) and (C) are fifth-degree felonies.

The classification depends on the precise subsection charged and the substance involved. We review both rather than assuming every prescription-related allegation carries the same felony level.

OARRS Records & Criminal Court Jurisdiction

The Ohio Automated Rx Reporting System, commonly called OARRS, is operated by the Ohio Board of Pharmacy. It collects information about outpatient controlled-substance prescriptions dispensed in Ohio and is used to detect possible drug diversion and doctor shopping.

An OARRS record may become part of an investigation, but the data must still be considered in context. We examine how investigators interpreted the prescription history and whether the records support the specific conduct alleged.

The alleged location of the conduct determines which court has jurisdiction. For conduct alleged in Cincinnati, felony cases are heard in the Hamilton County Court of Common Pleas, while Hamilton County Municipal Court handles misdemeanor criminal cases. In Butler County and other surrounding Ohio communities, Area Courts may handle misdemeanors and the initial stage of felony cases, with felony proceedings moving to the Court of Common Pleas after a grand jury indictment.
